The need for robust collaboration between the Nigerian Communications Commission (NCC) and the judiciary to accelerate the nation’s digital transformation took a centre stage at the commencement of the 2024 national workshop for justices and judges on legal issues in telecommunications at the instance of NCC.
The event is holding in Ikeja, Lagos state. In his welcome address, Dr. Maida underscored the pivotal role of the judiciary in accelerating Nigeria’s digital transformation, a process he noted is critical to enhance the country’s economic framework. He emphasized the importance of a robust legal and regulatory framework, especially in protecting telecommunications infrastructure designated as critical National Information Infrastructure by the recent Presidential Order, aimed at safeguarding essential communication services from vandalism and theft, which have plagued the industry.
Dr. Maida pointed out that the NCC’s commitment to digital transformation hinges on collaborative efforts with key stakeholders, particularly the judiciary. He noted that as the digital landscape evolves, the judiciary’s role becomes increasingly vital in ensuring the rule of law prevails within this sphere. According to him, “a functional digital economy is built on investor and consumer confidence, which are impossible in the absence of the rule of law, a critical element that is supplied by the judiciary.”
The Chief justice of Nigeria, Justice Kekere-Ekun highlighted the challenges posed by the rapid technological advancements in telecommunications. She expressed concerns regarding consumer data protection and cybersecurity, citing incidents of online banking fraud and the need for enhanced consumer safeguards.
The CJN notes that “the increased risk of personal data misuse necessitates improved strategies and innovation for consumer protection in the Telecommunications Sector.”
Justice Kekere-Ekun also noted that the workshop would provide an opportunity for judges to discuss current challenges in the telecommunications sector and develop strategies to address them. She urged participants to utilize the forum to update their knowledge and skills, emphasizing that an informed judiciary is crucial for resolving disputes arising from the evolving digital environment.
Both speakers recognized the necessity of adapting legal frameworks to accommodate the complexities of new technologies, asserting that the judiciary must actively participate in shaping laws that govern digital practices. Dr Maida and Justice Kudirat Kekere-ekun expressed optimism that the collaboration between the NCC and the judiciary would foster a robust legal framework that promotes innovation while ensuring consumer protection.
